Hi, I was in a accident 6/10/04. I was rear ender while I was sitting at a red light. The other driver was going about 15 miles per hour, I think a little more. The insurance company totaled both cars and we got $4500 for my vehicle. I want to know about a settle amount for pain and suffering. I have been going to the Dr., physical therapy, neurologist, chiropractor, and orthopedic (spelling). I am unsure of a pain and suffering amount. I do have a lawyer and they are involved, but they don't want to come right out and say, do this or that to make your settlement amount more, and I don't want to ask. I have heard that the best way to determine pain and suffering amount is based on how much your medical bills are. I live in Ohio and the maximum is $300,000. Has anyone had experience with State Farm Insurance? I do have minimal bulging discs, a rotated pelvis, and subluxations. The MRI's tend to say degenerative change, which I know is associated with arthritis, I am 34 years old, will this have a effect on my settlement, will they say this was previous and not want to pay. Any advice is appreciated thank you.

I was also rear ended in April 2004.
I went to the library and got books on insurance claims and auto accidents. This helped me quite a bit on how to put a claim in myself.
My Farmers PIP paid for medical care for 1 yr.
The other driver's insurance, Encompass fooled me into making a recorded statement. Then they used wrong or inaccurate information to base their denial of my claim. But I'm planning to file a lawsuit myself.
I had $1,300 damage to my car.
I really have muscle stiffness, spasms and have been unable to work etc., and feel that I have been violated. I'm 57 and also have some pre-existing conditions. I don't plan to use an atty.

I also was rear ended in june of 2003, stopped behind a truck and a school bus in front of the truck, we were all stopped at a railroad crossing, i've had serious pain and great sufffering from this "accident" I have been told by attorney, because of injury in 1998 , State Farm, this is the other drivers ins. co. that a settlement offer of 7,500. is about all i'll get, my car was totaled, i've been deemed permanently,totally disabled. by the time others get their share of that amount, i'll receive only 1 or 2 thousand. Florida is a no fault state. also I had seen no doctors for previous injury in 4-5 years, I have been put on SSI which is $603.00 a month, I can't prove income ability because of working in Barber/Beauty shops and they don't keep records and sad to say neither did I. What can be done at this time,? I have not signed any settlement papers. Thank You Shirley Penn
