Fall- who is responsible

We took a trip,  were going on a boat ride, boat moved, due to not be tied up  properly...wife Fell between boat and dock...did not fall in water..but had problem with leg and had to go to medical care a total of 38 times in 11 weeks...boat people did not talk to us...what would be your plan of action to compensate us for  the lost of 11 weeks of our life and the fact that she was in constant pain for  about 8 weeks of this time...
