On May 15, 2006, the FDA issued a press release stating: "Based on this scientific and epidemiological data suggesting that ReNu with MoistureLoc may increase susceptibility to Fusarium, Bausch & Lomb has decided to permanently remove the ReNu with MoistureLoc product worldwide." The recall followed Bausch & Lomb's conclusion that the product's formula may increase the risk of fusarium keratitis, a serious fungal eye infection.Bausch & Lomb, Inc. and the FDA both acknowledged there is a problem in the chemical properties of ReNu with MoistureLoc after testing confirmed that the solution allows a polymer film to form around the Fusarium fungus, preventing the disinfectant in the product from killing the fungus.

An estimated 30 million persons in the United States wear soft contact lenses; the annual incidence of microbial keratitis is estimated to be 4-21 per 10,000 soft contact lens users. Fungal keratitis is a condition more prevalent in warm climates. First-line treatment includes topical and oral antifungal medications; patients who do not respond to medical treatment usually require surgical intervention, including corneal transplantation. These infections are not transmitted from person to person. If not timely treated, Fusarium keratitis may lead to complete destruction of the cornea and loss of the eye itself.

  Glad your appt. went well!! I was thinking of you. Yes, I had a hard time and I had everything going on while the recall happened...and it was still hard. Especially remembering Doctor for the last 10 years!!!! I think they are just looking to tie something together with the lens instead of the solution, thats why they are asking about what brand. If more than "x" amount of people used a certain brand they will point the finger in that direction...away from themselves!!

I was curious to know (this is to Coxxy also if he's still reading) if you received any other paperwork to fill out right after receiving the original paperwork with a copy of the complaint?

Soon after I received my complaint and paperwork, I received another set of paperwork (much smaller packet) asking some of the same questions that I had already answered in the previous papers.  The first packet was sent 2-day while the second packet was first class.  Also the first packet had a submit date of Jan 14th while the second one had a submit day of the 15th.  Seems unusual!  And to add to it the address that is on the return envelope says Nursing Home Unit! Very confused!! One of these days I may become unbusy and be able to call them during business hours.  I don't see that happening in the near future.

Thats so funny, I got the exact same thing...and yes, it said nursing home unit??? I did call Michelle who is handling the Renu cases and asked her what was up. She pretty much said that they are trying to stay " a step ahead". If B&L says we're ready to talk numbers, they will have a good part of the paperwork done instead of trying to reach 600 people. I can see that ...however...she also said her bosses don't say everything until it happens hmmmmmm.  The other thing I find kind of strange, is if they just want to stay a step ahead, why did they only give us to the 15th..thats only 1 week. Seems to me thats very fast, for something that they just want to have on file. Maybe I am getting my hopes up and reading into it. For whatever reason this is being expedited...just not sure why yet.
  Did you read where B&L are sueing their insurance companies? They want them to help pay for all our cases. Two of them countersued!!! Then I start thinking...this is going to drag on forever!!! I am just as confused as you are lol. I just want my eyes back to the way the were before May 3 2006...I am so sick of eye issues, glasses etc. Stupid me turned my AC on in my car..dried out my eyes so bad, that for the last 2 days, they're all swollen and red and really hurt. Maybe living in Florida isn't for me now...I need AC and Fans!!!!! Oh Well, if you call, let me know what happens ok?

Wowzers AC huh?  You want to trade places with me? Please? I'm in Indiana and we had 10 inches of snow that quickly melted when the temp got up to an unheard of 65 degrees and then we received 5 inches of rain so we're flooded. I'm on high ground so I'm spared. smile

I also have a problem with running the heat now in my car.  I have to shut the vents off to me because my eye also suddenly dries up and it's awful.


I haven't heard of B & L suing their insurance company.  Usually I'm up on things.  I come home late in the evening and I spend at least an hour searching if there is any new news.  I'll have to look around for that.  Seems to me that if they are wanting their insurance companies to pay then we must have some good evidence.

I checked the steps to a lawsuit and with us being in discovery it seems that we're half way there.  At least I think so anyway.

I keep checking the court website and haven't seen any new court dates.  I was thinking maybe they sent the paperwork to everyone and will have future court dates after their deadline.  With as many people they are representing let's hope everyone gets their paperwork in by the deadline stated.

I will also let you know what I hear if I ever get the chance to call.

Linda, I see now about B & L suing their insurance companies.  I don't know how I missed it right here on the website.

Funny that the insurance company has a Jan 15th deadline.  I'm curious to know though is how and why would an insurance company file a counter claim.

I came across this article today and it pretty much explains why the insurance companies won't help B & L.

Lawyers for the Ace and Illinois companies denied the insurers are obligated to cover claims against B&L or help in the company's defense.

They said that B&L officials knew about the possible connection between MoistureLoc and the infection several months before the recall, and that any injuries were not "accidents."

That pretty much says it all in my eyes (no pun intended) smile

So I just now jumped in and saw all of this.  Sorry guys, I have really been busy with tax season and now with lowered interest rates!!  So its not looking too bad for us is what I am gathering from you guys.  I did also get the second round of paperwork from the attorneys.  I filled it out and gathered up some more info and sent it back to them.  Thank you for emailing me all of the reading.  Looks very promising at this point.  I might actually be able to see by the end of the year!!

Been wondering about you..glad your ok and just real busy!!  Thanks for responding, as Sandi said before wih all the people involved...it is surprising that more people don't communicate here! Oh well...they probably just read posts.
  I was having some terrible eye problems and it ended up being that my eyes are so dry, that when i wake up in the morning, my lid is stuck to my coreana and it actually tears it. My Dr. has me using some real "goopy" stuff to lube my eye before bed...what a pain in the a#$!!!!!!! It is something every few months with these darn eyes! Well, take care and stay in touch.

Since we started this litigation almost 2 years ago, we have sent our clients several letters with updates as to what is going on in the litigation.

Man am I slow to check this stuff.  Thanks for the info Mr. Parker.  I wish more of the folks who suffered from this would write on here and give us their experiences.  It means a lot to know that a lot of people have gone through this.  I just really want to get it settled and get my vision repaired and get my finances back on track.  This really set me back in a lot of ways.  How is everyone else doing with this?

Good to hear from you coxxxy!  I am doing ok, anxious to get this settled as well. My eyes are severely dry now..I never would have thought that Dry Eyes are a dangerous thing to have, boy was I wrong. I have episodes where I am driving and with no warning my eyes get so bad my options are to stop right where I am or crash!! Luckily, I have been able to stop and then pull over to the side. I have to put my head on the steering wheel and grab my face because it hurts so bad. For a few moments, it feels like the pain when I had 6 ulcers in my left eye.
  Other than that, I am doing well!! How about you?

I dont hurt like that anymore with mine.  My problem is extremely bad vision.  I need to have the transplant so I can see.  I cant see anything at night!!  I do have some dry eye but not as severely as you.  Ironically, having dry eyes is what drove me to use the solution that caused all of this!!!

Hi  coxxxy...I do wonder if when they are going through these cases, that everyone on both sides realize that people are waiting for these settlements for surgery that will hepl them? It is very frustrating to need money for medical and not have it!! It not like a get rich quick scheme like some cases...we really need it for medical procedures and we have to endure all these issues as long as this drags out...grrrrrrrr. I know some of us will never be the way we were prior to using the moisture loc but at this point I know I could be alot better than I am right now with surgery. Do you think the Judge takes any of this into consideration? I guess B&L has the right to drag it on as long as they want...I just wish there was a statue of say 2 years to settle with medical cases.
Oh well, wishful thinking on my part!!!  lol

Okay, I think I get it now. 
  The  doctor gave me 'temporary plugs' that dissolve first, to see if it helped.  I actually only noticed that my eyes didn't burn and itch etc., quite so much with them.  I asked about this and he said that you know if you DO NOT need them because your eyes will keep tearing and run down your face. I have never had the tears running down my face because my eyes are always SO dry and irritated.  Anyway, I got the permanent ones put in.  It took about 16 seconds for both eyes and I racked up a $900.00 bill for it. It was creepy but pretty painless-which is nice after all the eye pain.
  I  havent been able to pay for more than probably 5% of any of these bills, I have two tiny kids and I am still paying for having the last one!  I have health insurance too!
   The quick post is to all of you correct?  This dragging on and on makes me feel hopeless that anything good could come of this- I am already in collections, my credit was way over 700 until this eye thing.  Do you think they factor that into  it? I can't get a good mortgage rate, let see... What else CAN'T I do just because of the credit aspect- Sam's Club card? Nope..Not even that.
  The point is,  that B&L really has no idea how screwed some of us are because of this, neither does P&W, probably. I really do feel like P&W have their act together though, and that is nice.   
  Another note about the plugs:  My eyes are STILL dry and itchy and was it worth $900.00?  I just don't know- It could really help some of us I am sure.  Any feedback would be great-since it has taken me this long to actually sign up and write:)  Michigan

Thanks for writing Michigan, it is always so nice to talk to others going through the same thing as you. I keep putting off my surgery until the settlement comes through. I know it would put me in debt as well. I make decent money but my Husband got injured in Iraq and he works and gets some disability from the VA but it is not the money he used to make, so things are tough for us.  In a matter of 4 years..my life was upside down. My brother needed a Bone Marrow Transplant, I was a perfect match , so I became his donor and Caregiver for 8 months, met back up with Hubby (stationed in Texas) he got deployed to Iraq,  he got injured, we came back to Florida went on a cruise to relax bought the Moisture loc for the cruise because it was a travel size bottle and got the Fusarium....arghhhhhhhhhhh!!!!! It was like one thing after another!! Now I wait patiently for this settlement to get my eyes fixed!!
    I was little excited to get the plugs until I read your post, if it isn't 100% that it'll fix it, now I am not so sure! I have some type of eye problem daily, if I could get relief from the Dry Eye, I might be ok. I don't even go out on the boat anymore cause the wind swells my eyes shut! I tried turning, shielding my face  etc,,,doesn't matter, it still happens! More than anything through all this I can't stand glasses..I look so ugly in glasses. For my work, they are a constant problem for me. I learned to stop bitching because I can do nothing about it until the settlement, see what kind of money we get and then I can explore my options that will give me a better quality of life with my eyes.
  Well, be in touch and stay positive, some day this will settle and we all can get back on track with our eyes and financially. smile
