July 21, 2008 -- Today the Court approved the Trust's Refund Plan by Pretrial Order No. 7896. Refund Recipients will be notified of the amount of refunds in accordance with the Trust's Refund Plan, which is posted below.

That refund plan was approved waaaaaaay back on June 3rd when Bartle signed stipulation and the PTO 7860 (which was originally filed with the court on 5/9/08).
Now this newer PTO 7896, following 47 days AFTER the Judge had ALREADY approved the plan by signing the previous PTO, has covered butt for the trust and allowed them an additional 47 days in which to comply with the steps in their refund plan - the plan that they previously had failed to follow after PTO 7860 was signed. Whereas they (the trust) had been non-compliant following their own plan of distribution, this newer PTO has now fixed that problem for them.
How incredibly convenient is that??? UGH!!!!!!!!!!!!!

Joann, did you send it certified mail?

No next day has it's own tracking number and requires a signature. Certified mail is good so you can check on line it's status. Mine was a very large amount so it was easier to spend the 16.25 and get it there tomorrow. You can also send it 2 day with delivery confirmatin for $5.45. You can track it's delivery with that service as well and it will arrive within 2 to 3max days.
You can also put a regular stamp on it and it will probably do just fine. That's how all of our letters arrived.

SR,
I sent mine by priority mail with delivery confirmation . It cost $5 and something. You can go on line to the postal website and track it. That's how I've sent back just about everything and it worked out fine. It even tells you who signs for the mail when it gets picked up on their end.
So now we wait some more. Did you notice the letter was dated 7/31 - exactly 10 days from the date the latest order was signed. They waited their full 10 day before sending the letters What do you wanna bet they also wait the full 90 days before they finally cut the checks?

And speaking of interest - did you notice that it appears we're NOT getting any on this money?? Not a penny of interest for us for the years they been holding on to it. Seems
the trust fund gets to keep all the interest that's been earned on it.
Oh well, at least we're actually getting the refund...and 14K isn't anything I'd snub my nose at, interest included or not. Maybe keeping it all will allow them to pay a few extra claimants somewhere down the line when the fund starts running out.

Yeah, maybe.. still sucks.. lol... care to speculate when you 'think' they'll send the $?

My guess would be that they'll mail the checks on 10/17, which would be the last working day before their 90 day deadline. Hope I'm wrong and they send them as soon as they recieve the release but historically, getting things done in a quick and efficient manner is not usually the way they do things.

What is this money for? and for what? I haven't been on the board for a while.

This is a refund of the difference between the old common benefit fee of 9% and the new common benefit fee which is now only about 6.4%. Everyone who got paid on a matrix claim prior to the reduction paid the 9% and now they're refunding the difference. The refund only goes to claimants who didn't use a private attorney (pro se). For those who used a private attorney, the refund money belongs to the attorney and the claimant gets none of it.

I thought so but wanted to be sure. Thanks!

Any news on the refund ?

Glad to see someone posting. I go to the Pacer at least two times a week a lot of little things but nothing on the refund or when they are sending out checks.

You won't be seeing anything further on PACER about this refund. They'll just send the checks out and they'll most likely do that on or just before their 90 day timeline to do so expires. So expect the money about October 19th, give or take a few days.
