On September 15, 1997 the FDA asked American Home Products (now Wyeth), the manufacturer or fenfluramine (Pondimin) and dexfenfluramine (Redux) to voluntarily remove these drugs from the market. These anti-obesity drugs were prescribed by themselves or in combination with phentermine for weight loss. "Fen-Phen" refers to the use in combination of fenfluramine and phentermine.

The FDA decision to remove the drugs came after researchers at the Mayo Clinic and Mayo Foundation reported 24 cases of rare valvular disease know as Primary Pulmonary Hypertension or PPH in women who took the "fen-phen" combination therapy. Subsequently, FDA received 66 additional reports of heart valve disease associated mainly with "fen-phen." There were also reports of cases seen in patients taking only fenfluramine or dexfenfluramine.

should receive a refund ?

I'm not Marie but I'll try to answer.  If you are pro se (without an attorney) you should receive a refund.  If you had an attorney the 9% was deducted out of your attorneys portion so your attorney should receive the refund.  If you have an attorney you should not have paid any of the 9% and if you have you need to contact your attorney because it is his/her responsibility, not yours.

Daisy, I just finished reading through the document. Yes, you should be recieving a refund. As best as I can determine, it appears that the common benefit fee for those in the original settlement has been set at 6.39%... and for those in the 7th, at 6.4%. Assuming my interpretation of what I read is correct, we (those of us pro se in the original settlement) should expect a refund of what we paid as "class council fee"
Here's an example, based on my own claim, on how to calculate what to expect -

      $47,556.45   =    9% I paid as "class council fee" on claimant and derivative claim
  -    34,106.18    =    6.39%

=     $13,450.27         amount to be refunded to me and hubby

From what I read, it looks like the Trust has 30 days from today in which to compile and present to the court a plan on how they intend to get this money distributed to us. Once that's done, there will be another 15 days in which someone can decided to file an objection to whatever the Trust distribution plan is. Then the Trust has another 15 days to file a response to any objection.  So, don't plan on seeing any of this money for at least 2 months at the bare minimum... but whenever it finally comes, it will be a nice little bonus!!

So it will be at least two months for everybody, even those in the 7th?  Or will checks to our attorneys be distributed in 30 days? Sorry, I'm confused! Please clarify for me when you have time. Thanks in advance and congrats everybody!

If you were included in the motion for 'final' distribution, those checks will be disbursed to your attorney on or before 30 days from today, then your attorney will distribute to you.

Marie is talking about the cc fee reimbursements for those pro se members who already paid cc fees of 9% out of their settlements, and I am talking about the final distributions for those in the 7th amendment who have not paid any cc fees.  So we are talking about two different things.  Im pretty sure psychnurse was asking about the 7th amendment distributions.  The trust usually waits until the last day (30 days from today) to send to attorney via overnight delivery (or directly to class member if they are pro se), and then your attorney may hold the check for 7-10 days for it to clear their bank before they pay you.
