On September 15, 1997 the FDA asked American Home Products (now Wyeth), the manufacturer or fenfluramine (Pondimin) and dexfenfluramine (Redux) to voluntarily remove these drugs from the market. These anti-obesity drugs were prescribed by themselves or in combination with phentermine for weight loss. "Fen-Phen" refers to the use in combination of fenfluramine and phentermine.

The FDA decision to remove the drugs came after researchers at the Mayo Clinic and Mayo Foundation reported 24 cases of rare valvular disease know as Primary Pulmonary Hypertension or PPH in women who took the "fen-phen" combination therapy. Subsequently, FDA received 66 additional reports of heart valve disease associated mainly with "fen-phen." There were also reports of cases seen in patients taking only fenfluramine or dexfenfluramine.

Primary Pulmonary Hypertension can take years to develop. If you or a loved on took Fen Phen and was diagnosed with PPH you may have valuable legal rights, please complete the case inquiry form of the right side of this page for a free consultation.

Re: Trust's Refund Plan by Pretrial Order No. 7896= Approved

That refund plan was approved waaaaaaay back on June 3rd when Bartle signed stipulation and the PTO 7860 (which was originally filed with the court on 5/9/08).

Now this newer PTO 7896, following 47 days AFTER the Judge had ALREADY approved the plan by signing the previous PTO, has covered butt for the trust and allowed them an additional 47 days in which to comply with the steps in their refund plan - the plan that they previously had failed to follow after PTO 7860 was signed.  Whereas they (the trust) had been non-compliant following their own plan of distribution, this newer PTO has now fixed that problem for them.

How incredibly convenient is that??? UGH!!!!!!!!!!!!!

No next day has it's own tracking number and requires a signature.  Certified mail is good so you can check on line it's status.  Mine was a very large amount so it was easier to spend the 16.25 and get it there tomorrow.  You can also send it 2 day with delivery confirmatin for $5.45.  You can track it's delivery with that service as well and it will arrive within 2 to 3max days.

You can also put a regular stamp on it and it will probably do just fine.  That's how all of our letters arrived.

Re: Trust's Refund Plan by Pretrial Order No. 7896= Approved

SR,
I sent mine by priority mail with delivery confirmation . It cost $5 and something. You can go on line to the postal website and track it.  That's how I've sent back just about everything and it worked out fine. It even tells you who signs for the mail when it gets picked up on their end.

So now we wait some more. Did you notice the letter was dated 7/31 - exactly 10 days from the date the latest order was signed.  They waited their full 10 day before sending the letters  What do you wanna bet they also wait the full 90 days before they finally cut the checks?

And speaking of interest - did you notice that it appears we're NOT getting any on this money?? Not a penny of interest for us for the years they been holding on to it. Seems
the trust fund gets to keep all the interest that's been earned on it.

Oh well, at least we're actually getting the refund...and 14K isn't anything I'd snub my nose at, interest included or not.  Maybe keeping it all will allow them to pay a few extra claimants somewhere down the line when the fund starts running out.

Re: Trust's Refund Plan by Pretrial Order No. 7896= Approved

My guess would be that they'll mail the checks on 10/17, which would be the last working day before their 90 day deadline. Hope I'm wrong and they send them as  soon as they recieve the release but historically, getting things done in a quick and efficient manner is not usually the way they do things.

Re: Trust's Refund Plan by Pretrial Order No. 7896= Approved

This is a refund of the difference between the old common benefit fee of 9% and the new common benefit fee which is now only about 6.4%. Everyone who got paid on a matrix claim prior to the reduction paid the 9% and now they're refunding the difference. The refund only goes to claimants who didn't use a private attorney (pro se). For those who used a private attorney, the refund money belongs to the attorney and the claimant gets none of it.

Glad to see someone posting. I go to the Pacer at least two times a week a lot of little things but nothing on the refund or when they are sending out checks.

Re: Trust's Refund Plan by Pretrial Order No. 7896= Approved

You won't be seeing anything further on PACER about this refund. They'll just send the checks out and they'll most likely do that on or just before their 90 day timeline to do so expires. So expect the money about October 19th, give or take a few days.

someone from the trust called me last month i think-- claimed i forgot to check a box on the form...  so i gave him the answer verbally -- i can't BELIEVE i did that... anyways - he said that i was in the first batch of checks to go out which would be going out on October 21st...   we'll see how right they are..

Thanks SR!! Nothing came yesterday or today, so I hope it's really true that they mailed them today. Their 90 days was up on the 19th.  Why am I not surprised that they're late again as usual!!

Re: Trust's Refund Plan by Pretrial Order No. 7896= Approved

I am one of the "preservation" claims that were adjudicated and a list sent to the judge for approval of payment on August 7.  So far the judge has not signed it.  When I call the 7th people, they tell me they do not know why he hasn't signed it yet.  Does anyone have any idea what is happening with this?  (I am cynically thinking it's cause all their money was in a bank that went bust!!!)  Is anyone out there waiting, like I am, for some word?  I really thought this would be signed quickly since it is just an additional list.  Thanks for any info.

Yes I am waiting as well. This would be so simple just to sign and send our money! I was suppose to be in the very first distribution and wasn't because it was a mistake on their part and I am still waiting. I want to start my new home with this money. Good luck to all still on hold.
