Assault

My boyfriend was assaulted by a relative a couple of months ago. We didnt think the  injury was as serious as it was considering the ER Dr. wouldnt even do an x-ray. He just told us it was a muscle strain. The next day he could barely move went to a walk in and found out with x-rays that his back was fractured. At the time we did not file charges because the relative took off and the cops could not find him but we would like to file charges and sue him. I would also like to know if there is anything we can do to the Dr. at the ER?
