Traffic Accident

I would like to know the following regarding an insurance claim from a car wreck I was in on 9/01.  I was hit from behind and the police filed a accident report, showing the other person was to blame.  This is a claim filed in North Carolina. 

The insurance claim was filed in February 03', and as of yet the insurance company has not made an offer to pay. 

The insurance company stated they use a formula to determine the amount to settle a claim regarding medical bills, pain and suffering and disabilities.   Since I am not familiar with these forumla's nor do I want to solely trust the insurance company, I would to see if you can shine some light on the questions below.

Questions:

1.  What amount can I expect from the insurance company on the medical bills?  Percentage or 1-3 times the medical expenses?
2.  What about Pain and Suffering?
3. Loss of pay?
4. Disability of 5% on my shoulder?  What amount?

Any help regarding this will be greatly appreciated.

Quit wasting your time, ask around to your friends and family and find you the best personal injury lawyer in your town. You will get [b]SQUAT[/b] from the insurance company without a lawyer. Granted, the lawyer will get a percentage of it but even less his fees, you will wind up ahead. Make sure that the lawyer is willing to take your case on contingency so that you are never out any money from your pocket.

I'm not familiar with California/USA laws - nor the compensations laws there. nor am Ia lawyer. yet I find myself- 9 y. after accident on Israel's main highway - in a simmilar case like you. during the last 6 years been active and learned from injured people and injured netforums - how t"the deals" are done, and what goes/not goes around.
     for the last 2 years - am an adamant active surfer in disabled forums/groups all over the net, including paticipation in forum for advising
the ad-hoc UN commity for equal international laws for disabled.

first , I understand your accident happened in september 2001. that so?
also understand you were hospitally treated for shoulder injur -a break?
Q: what part was injured-how much time in hospital,how much time treaed outside hospital? explain please. acuracy of answers - rely on the data.

second, I think you suffer ( then and now)from more injured parts.Q: please specify.

third - explain your situaion/position in your "life road" did you feel well andlived well socially & medically?           Q: how much of that do you feel now - or feel amis?

now - to some answers-
1. insurance companies - are not humanitarian non profit org. nowhere in the world. their prime goal - to make the individuals owning -millioners.
their "prime act" - is to put your claim, on as little pay as they can. some companies will also "go the extra step" to breakalaw here and there - for financial benefits. most companies in any country - are 'partnersin a Cartel' and pass data on persons and claims from each other.
this is common in iIsrael, European commons and USA.
the insurance co. - your s, not that of the offender is giving you "an offer"?
by brittish law (the basic fundamen for insurance and insured laws-international)says that you can take it commercially - or counter it with an offer ,commercially, back. there is no agreement untill both sidesagree on one offer, without condition and under no presure.
2. about pain, suffering-
the insurance companies have a chart - for maximum compansation for pain(from the accident). it is backed usually by judges. in Israel - the amount is up to 125,000 sheqels(divide by 4.35 for $).
please do not accept this as "the true amount" nor as the only you have to get. lawyers know better.

3.loss of pay? you should have proof(true papers as witnesses)for past payment/selary and make calculation for the future pay -"you might have got if there was no accident". this will include - promotion, a bank's statement of future earning percentage of a sum equal your pay.

4.disability percentage -??? how is that performed and done??
if you can be assesed by an agreed doctor(you and the insurance agree to accept his finds "as is", a base for payment). the doctor makes a witnessed report(legally) ofyour medical conditions -a) at accident time. b)now  c)in future and possible future health deteriraions - from the accident.

as you see - there are many calculations to do - andlots of  n e g o t i a ting. you have to be able to cheq up on your lawyer.or - havea wife/son/daughter do so.

I was in acar accident in May of 2003, i was the passenger. i had physcial therapy because i had a herinated disk in my back and my right shoulder was dislocated and i had to get an operation on my right shoulder. i been out of work for 11 months and just recently went back to work, but my shoulder is paining me really bad and the cold weather makes it very very painful, what should i do about the situation being they stopped my physical therapy because they are working on my settlement, while im typing now my shoulder is killing me what should i do go to another doctor or what, my shoulder is hurting more than it did when i dislocated it the first time.

Unfortunate. I've had a number of scrapes on NJ roads, (the worst in my view), so I got a little video camera they call Eyewitness Camera. It sits on your dash and records video footage as you drive. If you get into an accident, you have all the evidence you need.
