advice

my husband was injured on the job just about a year ago. he was then fired because they said he could no longer perform the tasks he was hired to do at the level of efficiency required. then he had a nervous breakdown. he filed a lawsuit. turns out the company supposedly had no insurance (I find this extremely difficult to believe). Long story short: the attorney told him it would probably cost him more to pursue than he'd be likely to receive.
end result: my spouse is permanently injured and now, because of all the meds he's taking following his breakdown combined with his physical infirmities, he can't hold a job and is deteriorating before my eyes. side effects from the meds combined with depression keep him sleeping 12-15 hours a day, in pain....and so on and so on.
it's NOT the life he deserves! I don't think he should have dropped his lawsuit but he's a grown man and makes his own decisions. I just don't think his former employer should get away with denying him worker's comp. if anyone has some advice, I could sure use some. THANKS.

My husband was also hurt on the job, three years ago he fell while installing a window 15ft. and broke his neck, leg. He had to get operated on, and they took bone from his hip and put it in his neck. He was almost paralyzed. God, I can't believe that they fired your husband. My husbands employer kept giving us the run around about the Workmen's Comp. checks for almost three months. And he would not return any calls, so we had to get a lawyer. Trust me it was a long process. We lost our house and both cars. Almost everything we had I had my husband in a hospital bed and my daughter was only 2 months old. It was hell. and no insurance and 95,000 worth of hosptial bills. I don't know what state you are from but if you find a lawyer that will take your case on contingency. We went to 4 lawyers and they said the same thing that your lawyer did. But then we found our lawyer it took a 1 1/2 years but we won and they had to give us all of his back pay. And pay him every two weeks. All you have to do is find a lawyer that specializes in Workmen Comp. Your husband would probably feel so much better if there was money coming in. My husband did the dame thing he just slept, he fellt useless. Even now he gets so depressed because construction was his life he loved to do it.They HAVE to have insurance try and look alittle deeper because even if he wasn't carrying it by law he had to so you could still take him to court and he would have to pay back everything that they award you. I mean how long was he working for him?? Were they working on a house ?? Sorry that I am writing you a mile long letter but if you need to talk or ask anything just email me.  Diane
