On September 15, 1997 the FDA asked American Home Products (now Wyeth), the manufacturer or fenfluramine (Pondimin) and dexfenfluramine (Redux) to voluntarily remove these drugs from the market. These anti-obesity drugs were prescribed by themselves or in combination with phentermine for weight loss. "Fen-Phen" refers to the use in combination of fenfluramine and phentermine.

The FDA decision to remove the drugs came after researchers at the Mayo Clinic and Mayo Foundation reported 24 cases of rare valvular disease know as Primary Pulmonary Hypertension or PPH in women who took the "fen-phen" combination therapy. Subsequently, FDA received 66 additional reports of heart valve disease associated mainly with "fen-phen." There were also reports of cases seen in patients taking only fenfluramine or dexfenfluramine.

965 TOTAL claims

grid payments - 139 claims
FDA+ - 137 claims
$2000 minimum payments - 424 claims
Fatally deficient - 103 claims
Fatally deficient with no proof of drug use - 148 claims
Progression during pendency claims - 14


Now have to wait for the Judge to sign it and then they should pay within 30 days thereafter. Appears that there's still some claims remaining to be finalized, so there will be yet another motion to pay sometime later.

Hello Marie, I haven't posted for a long while. Hope everyone's doing well. I just look in on the board several times a week,I did notice this. Marie does this mean that they have finished all but a few cases? I mean they kept telling us thst they still had  about 1000 cases left to do. I just wandered if this is what you are talking about?  If it is, it seems like the pass rate stayed the same through the entire process. Well Take Care Marie.  Debbiel

Yes, this is about some of those claims that had not been included in the last "final" distribution. It definately sounds like they've still got more to go. How many more, I couldn't tell you because they gave no indication.  Seems I remember the amount that was kept in reserve for the remaining claims was something like $60 million. If so, then this latest distribution has only used up about $30 million of it, so half of it still remains.

Hi, Marie - Does it appear, that those who received the final distribution check would be getting another check.  I was told it would be a final another check but it would be a much smaller amount.  My lawyer stated that more had passed than had been expected and that the amount would be reduced and that was how the final distribution was calculated.  Just wondering - trying to keep an eye on everything.

As far as I'm aware, there's still going to be a pro rated distribution to those who recieved grid money from whatever money is left when they're completely finished all the claims.  But I have no idea how much that might be for each person.

When they filed the first motion for final payment, they said there were still 1,084 cat ones claims left at that time.  So with this latest motion finishing up 965 of them, there should now be only 119 remaining. The total amount which was set aside was about $67.5 million and they've now used up just over $32 million of it. With only 119 total claims now remaining, and probably no more than 20% at best expected to pass review, there should still be over $35 million left in reserve to pay those few claims and whatever administrative expenses there are. I can't imagine it will take anywhere near that much to finish it all off, so whatever is left will be coming your way at some point.

If there is a final check does anyone have any idea about when that could possibly be?Almost 2 months have passed since the first post on this subject will they post on pacer when all has been completed?just curious

I don't have any idea when the absolutely final payments might happen, but whenever it does there will be another motion that can be viewed on PACER - probably one that details how the entire 7th pot of money got distributed. I'm sure it will also be posted on the 7th website just like the latest one was posted in August.

Hello Marie, I am new to this forum . I too am included in this class action law suit and have not recieved any money at all yet. My claim has been adjudicated and a motion has been made on 8/7/08 to make payment but the judge has yet to sign the motion. Would you have any idea if there is a time frame for him to sign? I am almost 62 years old and have a matrix level injury and hope I am able to recieve a payment soon as I have to have surgery with or without the settlement. Thanks so much

Yes, all the 7th people who recieved grid money should be getting a prorated share of however much is leftover after everyone and everything has been paid.  I have no idea when that might happen though, but I suspect it might still be a little while off.

As you can see from Tazgrans question above, there are still a group of those most recently adjudicated who are waiting for the judge to sign the motion so they can be paid. For all I know, there might even be yet another small group to follow (and there probably is) that will also have to wait for another motion to be signed by the judge. So I kind of doubt the 7th is going to fully wrap it all up and distribute the left over money anytime real soon. It'll happen eventually, but just like everything has always been with this settlement - it's a very slow process.

Hello all.  I am new to this board and have been waiting for a judge to sign the Aug 7th paperwork although my understanding is it isn't officially an order.  It is now Oct 23rd and I have seen and heard nothing.  Fund people can only say "I don't know".  What kind of an answer is that?  When you are told in April you are getting X number of $ you would like to have it now.  I was told in June that it would come end of August, then in August I was told Sept/Oct and now all I get is "I don't know".  Has anyone received a cheque recently?  Catcatrose

Thx LKC....I too have been a little pre-occupied.  I am up in Canada and can't help thinking that my money is lost in some bank never to be seen again.  Whenever I talk to the fund administrators they always give some lame excuses and if they run out they point blank tell me "I don't know"  Catcatrose
